The AdSmartly Weekly Prize Draw ("Sweepstakes") is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Void in Puerto Rico, US territories, and wherever prohibited or restricted by law.
The following persons are not eligible to participate: employees, officers, directors, and agents of AdSmartly Inc., its affiliates, subsidiaries, advertising agencies, and prize fulfillment agencies; any currently active participating advertiser's employees involved in the administration of this Sweepstakes; and immediate family members (spouse, parent, child, sibling) and household members of the foregoing.

The Sweepstakes operates on a continuous weekly cycle. Each weekly cycle runs from 12:00:01 AM Eastern Time (ET) on Monday through 11:59:59 PM ET on Sunday ("Draw Week"). Three separate prize draws are conducted each Draw Week:
The Sweepstakes begins on the official launch date of the AdSmartly platform and continues until terminated by Sponsor with 30 days' notice.
To earn draw entries through the standard method: download the AdSmartly app (available on iOS and Android), create a verified account, watch an eligible advertisement in full (no skipping), and correctly answer at least 2 of 3 quiz questions about the advertisement. Each successful quiz completion earns one (1) draw entry for the current Draw Week.
Entries are non-transferable. Entries earned on Day 1–2 of a Draw Week are eligible for all three draws in that week. Entries earned on Days 3–7 are eligible for the Grand Prize Draw only. No limit on total entries per week, subject to daily Energy System caps as described in the app.
No purchase is necessary. To enter without watching an advertisement, hand-print your full legal name, complete mailing address, email address, date of birth, and the specific Draw Week you wish to enter on a 3" × 5" card. Mail to:

Mail entries must be postmarked by Thursday of the Draw Week you wish to enter and received by the following Monday. Each mailed entry earns one (1) draw entry for the Grand Prize Draw of the specified week only. Limit: one (1) AMOE entry per person per Draw Week. AMOE entries have the same odds of winning as app-earned entries from the same eligibility pool.
The total prize pool for each Draw Week is funded by 25% of all net advertising revenue collected during that Draw Week. The pool is divided among the three draws as follows:

Regardless of advertising revenue, the Sponsor guarantees minimum prize amounts for each draw:

If the calculated prize pool produces a prize below the guaranteed minimum, AdSmartly will supplement from operating reserves to reach the minimum amount.
Winners are selected by a certified random number generator operated by AdSmartly or its designated third-party administrator. Each eligible draw entry has an equal chance of being selected. The same person may win multiple draws within a single Draw Week. There is one (1) winner per draw.
The random selection process is logged and time-stamped. Records are retained for 3 years and are available for inspection by regulatory authorities upon request.
Potential winners will be notified via in-app push notification and email within 2 hours of each draw. To claim a prize, the potential winner must: respond within 72 hours of notification, complete identity verification (government-issued ID), confirm their Stripe payment account or provide bank details for direct deposit, and sign and return an Affidavit of Eligibility and Liability/Publicity Release within 5 business days.
Failure to respond within 72 hours, failure to pass identity verification, or failure to return required documentation within 5 business days will result in prize forfeiture and selection of an alternate winner.
All prizes are cash prizes delivered via Stripe bank transfer (ACH direct deposit) to a US bank account in the winner's name. Prize payments are processed within 24 hours of completed winner verification. AdSmartly is not responsible for bank processing delays. Prize winnings are in US dollars. No cash equivalent substitution or prize transfer is permitted, except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize is unavailable.
All federal, state, and local taxes on prizes are the sole responsibility of the winner. AdSmartly will report prize winnings to the IRS and issue Form 1099-MISC for prizes of $600 or more in a calendar year. Winners may be required to provide a completed W-9 (or W-8BEN for eligible non-US residents) before prize payment is processed.
Except where prohibited by law, acceptance of a prize constitutes consent for AdSmartly to use the winner's name, likeness, city, and state for advertising and promotional purposes in any medium without additional compensation. Winners may opt out of name/likeness use while still accepting their prize by written request to [email protected] within 5 days of prize notification. However, winner's name and general location (city/state) may be publicly disclosed as required by applicable sweepstakes law regardless of opt-out.
Any attempt to interfere with the operation of this Sweepstakes, including but not limited to: using automated entry tools, creating multiple accounts, manipulating the app or entry system, using VPN/proxy services to misrepresent location, colluding with other entrants, or submitting fraudulent winner verification information will result in immediate disqualification, forfeiture of all entries and prizes, and may be reported to law enforcement. AdSmartly reserves the right to disqualify any entrant for any reason at its sole discretion and to modify, suspend, or terminate the Sweepstakes if fraud or technical failure compromises its integrity.
By entering, participants agree to release and hold harmless AdSmartly Inc., its officers, directors, employees, and agents from any and all claims, losses, harm, or damages arising from participation in the Sweepstakes or the acceptance and use of prizes. AdSmartly is not responsible for: late, lost, or misdirected entries; technical failures; incorrect or inaccurate prize pool calculations due to advertiser payment failures; or any printing or typographical errors in Sweepstakes materials.
Except where prohibited, by entering this Sweepstakes, participants agree that: (i) any dispute shall be resolved individually, without resort to any form of class action; (ii) any claims shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association; (iii) the Federal Arbitration Act governs all such proceedings. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
For a list of prize winners (available after each draw), send a self-addressed stamped envelope to: AdSmartly Inc., Attention: Weekly Draw Winners List, [Address to be confirmed at launch]. Requests must be received within 60 days of the relevant draw date. Alternatively, winner names will be posted at ad-smartly.com/winners within 48 hours of each draw.
